Acceptance of Terms
By accessing or using the Luxus Collection website (luxus-collection.com) or purchasing from us, you agree to be bound by these Terms & Conditions. If you do not agree, do not use our site or services. We reserve the right to modify these terms at any time. Continued use of our site after changes are posted constitutes acceptance of the revised terms. Please review these terms each time you place an order, as they are subject to change.
Eligibility
You must be at least 21 years of age to purchase any firearm through our site. You must be legally permitted under federal, state, and local law to purchase and receive the firearm(s) you are ordering. By completing a purchase, you represent and warrant that you meet all eligibility requirements. Providing false information in connection with a firearm purchase is a federal felony.
Customer Certification
By completing a purchase, you certify that all of the following are true: 1. You are the actual transferee/buyer of the firearm and are not acquiring it on behalf of another person. 2. You do not intend to sell or otherwise dispose of the firearm in furtherance of any felony, federal crime of terrorism, or drug trafficking offense. 3. No federal, state, or local law prohibits you from purchasing, possessing, or having firearms shipped to an FFL of your choice. 4. You are at least 21 years of age. 5. You are not under indictment or information in any court for a felony or crime punishable by imprisonment for more than one year. 6. You have never been convicted in any court of a felony or crime punishable by more than one year of imprisonment. 7. You are not a fugitive from justice. 8. You are not an unlawful user of, or addicted to, marijuana or any controlled substance. 9. You have never been adjudicated as a mental defective or committed to a mental institution. 10. You are not an alien illegally or unlawfully in the United States. 11. You have not been discharged from the Armed Forces under dishonorable conditions. 12. You have not renounced your United States citizenship. 13. You have not been convicted of a misdemeanor crime of domestic violence. 14. You are not subject to a court order restraining you from harassing, stalking, or threatening an intimate partner or child. 15. You are not an alien admitted to the United States under a nonimmigrant visa (unless an exception applies under ATF Form 4473). 16. You agree that you will not sell or give the firearm to any prohibited person.
Product Listings
We make every effort to accurately represent our products, including descriptions, photographs, specifications, and pricing. All items are sold on an 'as-is' basis. Item descriptions are based on our thorough evaluations; however, descriptions can be subjective and influenced by individual perception. We reserve the right to correct errors, update pricing, or discontinue products at any time without notice. All sales are subject to product availability at the time of order processing. In the event a listed item becomes unavailable after purchase, we will notify you promptly and offer a full refund.
Pricing and Payment
All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to cancel any order in the event of a pricing error. Sales tax is collected in states where we have nexus, in compliance with applicable law. Payment must be received in full before any firearm is shipped. We accept Visa, Mastercard, American Express, Discover, certified checks, personal checks, and bank wire transfer. Credit card fees are not included in listed prices. Orders paid by personal or business check will be shipped once funds have cleared. All payments must be completed within 7 days of order placement. Orders paid by credit/debit card, cashier's check, certified funds, or wire transfer will ship within 3 business days of receipt and confirmation of funds. Personal and business checks are subject to a 10 business day hold after deposit.
FFL Transfer Requirement
All firearm purchases are shipped to a licensed Federal Firearms Licensee (FFL) dealer designated by the buyer. The buyer is responsible for providing accurate FFL dealer information at checkout. The FFL dealer must provide a copy of their license to Luxus Collection prior to shipment. Luxus Collection is not responsible for delays, fees, or complications arising from the buyer's FFL dealer. The buyer is solely responsible for understanding and complying with all applicable state and local laws governing the receipt and possession of the purchased firearm.
Firearm Condition Upon Transfer
We strongly encourage customers to inspect the firearm thoroughly at the FFL prior to completing the transfer. Once a firearm has been transferred to the buyer and the buyer has taken possession, it is no longer considered new and is deemed used, regardless of whether it has been fired. Once transfer is complete and possession is taken, the sale is final. If there are any concerns or discrepancies, the buyer must notify Luxus Collection prior to accepting the transfer.
Returns, Refunds & Cancellations
All sales are final. Luxus Collection does not accept returns on firearms. In exceptional circumstances, return requests may be considered on a case-by-case basis at our sole discretion. Approved returns are subject to a 25% restocking fee. Original shipping, handling, insurance, and any transfer fees are non-refundable. Items must be unused, unfired, and in the exact condition sold, including all original packaging and accessories. A 25% restocking fee applies to any order canceled after payment has been processed, including where the buyer fails to complete transfer, provides incorrect FFL information, or refuses delivery. State Restrictions & Legal Compliance
Customer is solely responsible for checking applicable federal, state, and local laws regarding the purchase, possession, or use of any firearm in their jurisdiction. Luxus Collection will not ship firearms to any state where purchase, possession, or shipment is prohibited. We provide guidance on regulations applicable within the State of Florida only. Should a transaction be canceled due to local legal restrictions, a 5% cancellation fee will apply. Items returned due to regulatory issues will incur a 5% restocking/processing fee, and any additional shipping costs will be the buyer's responsibility.
Prohibited Transfers
Luxus Collection does not engage in straw purchases (purchasing a firearm on behalf of someone legally prohibited from purchasing one). We will refuse any order we reasonably believe constitutes a straw purchase or other prohibited transfer. We reserve the right to cancel any order for any reason without liability. Any advertisement or offer is void where prohibited by law.
Contract Acceptance
Placement of an order does not constitute acceptance of an offer to purchase. The sole means by which Luxus Collection contracts to fulfill orders is by shipment. Notwithstanding anything to the contrary, Luxus Collection disclaims any acceptance of an order until the order has shipped.
Intellectual Property
All content on this site — including text, photographs, graphics, logos, and design — is the property of Luxus Collection LLC or its content suppliers and is protected by U.S. and international copyright law. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
Limitation of Liability
To the maximum extent permitted by law, Luxus Collection's liability for any claim arising from a purchase or use of our site is limited to the amount paid for the specific product giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages. Some states do not allow limitations on implied warranties or exclusions of certain damages, so these limitations may not apply to you.
Governing Law & Dispute Resolution
These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict of law provisions. Any dispute arising from these terms, your use of our site, or any transaction shall be resolved exclusively in the state or federal courts located in Manatee County, Florida. You irrevocably consent to the personal jurisdiction of such courts.
