Acceptance of Terms
These Terms and Conditions (the “Terms”) govern your access to and use of the Luxus Collection website at https://luxus-collection.com (the “Site”), including purchases, waitlists, item-availability alerts, newsletters, and other services offered by Luxus Collection LLC (“Luxus Collection,” “we,” “us,” or “our”). By accessing or using the Site, creating an account, submitting a waitlist or item-availability request, or purchasing from us, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or our services. We may revise these Terms from time to time. The revised Terms will be posted on the Site with an updated effective date. Changes apply prospectively when posted or on any later date stated in the notice. Your continued use of the Site after the revised Terms take effect constitutes acceptance of those revisions.
Waitlists, Item-Availability Alerts, and Email Marketing
When you submit your name, email address, or other contact information through a waitlist, back-in-stock, item-availability, inquiry, newsletter, or similar form, you request and authorize Luxus Collection to contact you about the applicable item or request. If the form also clearly states that you are signing up for promotional communications, you further consent to receive marketing emails from Luxus Collection and its Affiliates concerning products, services, promotions, events, editorial content, and other offers that may interest you. For purposes of these Terms, “Affiliates” means entities that control, are controlled by, or are under common control with Luxus Collection, including websites operated by those entities. Promotional emails may be sent by Luxus Collection, by an Affiliate identified in the message, or by a service provider acting on the sender’s behalf. We will not authorize an unaffiliated third party to send marketing emails directly to you based solely on a Luxus Collection signup unless the signup disclosure and our Privacy Policy clearly explain that sharing and identify the third party or the relevant category of third parties. Offers from independent businesses may instead be included in emails sent by Luxus Collection. You may unsubscribe from marketing emails at any time by using the unsubscribe link in an email or by contacting us through the Site. We will process opt-out requests as required by applicable law. Opting out of marketing emails will not prevent us from sending non-marketing communications that are necessary to complete a transaction, administer your account, respond to your request, provide legal or safety notices, or service an order. Joining a waitlist or requesting an availability alert does not reserve an item, guarantee that an item will become available, lock in a price, create an obligation to purchase, or require Luxus Collection to offer or sell the item to you. Items remain subject to availability, eligibility requirements, pricing in effect when an order is accepted, and all applicable laws. You may submit only contact information that belongs to you or that you are authorized to use. You are responsible for keeping your information accurate and current.
Telephone Calls and Text Messages
An email-only waitlist or availability signup does not, by itself, authorize Luxus Collection or any Affiliate to send automated marketing text messages or place automated or prerecorded marketing calls. If we offer text-message or telephone marketing, we will request any consent required by applicable law through a separate, clear disclosure associated with the telephone number provided. Consent to marketing texts or calls will not be a condition of purchasing any property, goods, or services. Where applicable, message frequency may vary, and message and data rates may apply. A recipient may revoke consent through any reasonable method, including replying STOP to a text message. We may send one non-marketing message confirming an opt-out request.
Privacy
Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy. The Privacy Policy should be read together with these Terms. If we share contact information with Affiliates so they may send their own marketing communications, that practice will be disclosed in the Privacy Policy and, where required, at the point of collection.
Eligibility
You must be at least 21 years of age to purchase any firearm through the Site. You must be legally permitted under federal, state, and local law to purchase and receive each firearm you order. By completing a purchase, you represent and warrant that you meet all eligibility requirements. Providing false information in connection with a firearm purchase may result in serious criminal penalties.
Customer Certification
By completing a firearm purchase, you certify that all of the following are true: 1. You are the actual transferee/buyer of the firearm and are not acquiring it on behalf of another person. 2. You do not intend to sell or otherwise dispose of the firearm in furtherance of any felony, federal crime of terrorism, or drug-trafficking offense. 3. No federal, state, or local law prohibits you from purchasing, possessing, or having firearms shipped to an FFL of your choice. 4. You are at least 21 years of age. 5. You are not under indictment or information in any court for a felony or crime punishable by imprisonment for more than one year. 6. You have never been convicted in any court of a felony or crime punishable by imprisonment for more than one year. 7. You are not a fugitive from justice. 8. You are not an unlawful user of, or addicted to, marijuana or any controlled substance. 9. You have never been adjudicated as a mental defective or committed to a mental institution. 10. You are not an alien illegally or unlawfully in the United States. 11. You have not been discharged from the Armed Forces under dishonorable conditions. 12. You have not renounced your United States citizenship. 13. You have not been convicted of a misdemeanor crime of domestic violence. 14. You are not subject to a court order restraining you from harassing, stalking, or threatening an intimate partner or child. 15. You are not an alien admitted to the United States under a nonimmigrant visa, unless an exception applies under ATF Form 4473. 16. You will not sell or give the firearm to any prohibited person.
Product Listings
We make reasonable efforts to accurately represent our products, including their descriptions, photographs, specifications, condition, and pricing. All items are sold on an “as-is” basis to the extent permitted by law. Item descriptions are based on our evaluations, but descriptions of condition and appearance may involve judgment and individual perception. We may correct errors, update pricing, or discontinue products at any time without notice. All sales are subject to product availability when an order is processed. If an item becomes unavailable after payment, we will notify you promptly and offer a full refund.
Pricing and Payment
All prices are stated in U.S. dollars and may change without notice. We may cancel an order affected by a pricing or listing error. Sales tax is collected where required by law. Payment must be received in full before a firearm is shipped. We accept Visa, Mastercard, American Express, Discover, certified checks, personal checks, and bank wire transfers. Any credit-card fee will be disclosed before payment. All payments must be completed within seven days after order placement. Orders paid by credit or debit card, cashier’s check, certified funds, or wire transfer generally ship within three business days after funds are received and confirmed. Orders paid by personal or business check will ship only after the funds clear and are subject to a ten-business-day hold after deposit.
FFL Transfer Requirement
All firearm purchases must be shipped to a licensed Federal Firearms Licensee (“FFL”) selected by the buyer. The buyer is responsible for providing accurate FFL information. The FFL must provide a copy of its license to Luxus Collection before shipment. Luxus Collection is not responsible for delays, fees, or complications caused by the buyer’s selected FFL. The buyer is solely responsible for understanding and complying with all federal, state, and local laws governing receipt and possession of the purchased firearm.
Inspection and Firearm Condition Upon Transfer
You should inspect the firearm thoroughly at the receiving FFL before completing the transfer. Once the firearm has been transferred and you take possession, it is deemed used regardless of whether it has been fired, and the sale is final. You must notify Luxus Collection of any concern, damage, or discrepancy before accepting the transfer.
Returns, Refunds, and Cancellations
All firearm sales are final, and Luxus Collection does not ordinarily accept firearm returns. In exceptional circumstances, we may consider a return request on a case-by-case basis in our sole discretion. An approved return is subject to a 25% restocking fee unless a different fee is required by law or expressly stated in an applicable written policy. Original shipping, handling, insurance, transfer fees, and other third-party charges are non-refundable. Any approved return must be unused, unfired, and in the exact condition sold, with all original packaging and accessories. A 25% restocking fee applies to an order canceled after payment has been processed, including when a buyer fails to complete the transfer, provides incorrect FFL information, or refuses delivery, except where prohibited by law or where a different fee is expressly stated in an applicable written policy. State Restrictions and Legal Compliance
The customer is solely responsible for checking all applicable federal, state, and local laws concerning the purchase, possession, receipt, or use of a firearm or other product. Luxus Collection will not knowingly ship a firearm where its purchase, possession, or shipment is prohibited. Any guidance we provide concerning Florida law is general information and is not legal advice concerning another jurisdiction. If a transaction is canceled because of a legal restriction applicable to the customer, a 5% cancellation fee will apply unless prohibited by law. An item returned because of a regulatory issue will incur a 5% restocking or processing fee, and the buyer will be responsible for additional shipping costs, unless prohibited by law.
Prohibited Transfers
Luxus Collection does not participate in straw purchases or other prohibited transfers. We may refuse or cancel any order we reasonably believe involves a straw purchase, a prohibited person, false information, fraud, or other unlawful activity. We may cancel an order for any lawful reason. Any advertisement or offer is void where prohibited.
Order Acceptance
Placing an order is an offer to purchase and does not constitute our acceptance. Luxus Collection accepts an order only when the item is shipped, unless we expressly confirm acceptance in a separate written communication. We may decline or cancel an order before acceptance, subject to any refund obligation imposed by law or these Terms.
Intellectual Property
All content on the Site, including text, photographs, graphics, logos, and design elements, is owned by Luxus Collection LLC or its licensors and is protected by applicable U.S. and international intellectual-property laws. You may not reproduce, distribute, publicly display, or create derivative works from Site content without prior written consent, except as permitted by law.
Disclaimer and Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXUS COLLECTION’S TOTAL LIABILITY FOR A CLAIM ARISING FROM A PURCHASE OR USE OF THE SITE WILL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXUS COLLECTION WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. Some jurisdictions do not permit certain warranty disclaimers, damage exclusions, or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.
Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Except where applicable law requires otherwise, any dispute arising from these Terms, the Site, or a transaction must be brought exclusively in the state or federal courts located in Manatee County, Florida. You consent to the personal jurisdiction of those courts.
Severability; No Waiver
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce any provision is not a waiver of the right to enforce it later.
Entire Agreement
These Terms, together with the Privacy Policy, Shipping and Returns Policy, and any other policy or disclosure expressly incorporated by reference, constitute the entire agreement between you and Luxus Collection concerning the Site and the transactions and services governed by these Terms.
